    ২০০৯ থেকে ২০২৪ সালের মধ্যে বাংলাদেশের বিচার বিভাগকে একটি স্বাধীন সাংবিধানিক প্রতিষ্ঠান থেকে রূপান্তর করা হয় একদলীয় শাসন টিকিয়ে রাখার প্রধান প্রশাসনিক হাতিয়ারে। ষোড়শ সংশোধনীর রায়ের পর প্রধান বিচারপতিকে জোরপূর্বক অপসারণ এবং ‘গায়েবি মামলা’র কারখানা চালুর মাধ্যমে আদালতকে বিরোধীদের কারাগার বানানোর অস্ত্রে পরিণত করা হয়।

    ২০১৭ সালের জুলাই মাসে সুপ্রিম কোর্টের আপিল বিভাগ সংবিধানের ষোড়শ সংশোধনী সর্বসম্মতভাবে বাতিল করে। রায়ে বলা হয়, বিচারকদের অপসারণের ক্ষমতা সংসদের হাতে থাকলে বিচার বিভাগের স্বাধীনতা ধ্বংস হবে। তৎকালীন প্রধান বিচারপতি সুরেন্দ্র কুমার সিনহা রায়ে লেখেন— “কোনো দেশ কোনো একক ব্যক্তির দ্বারা বা একক ব্যক্তিমালিকানাধীন হতে পারে না”

    এর পরপরই রাষ্ট্রযন্ত্রের প্রতিশোধ নেমে আসে:

    • প্রধান বিচারপতিকে নিজ বাসভবনে গোয়েন্দা নজরদারিতে গৃহবন্দী করা হয়।
    • চিকিৎসার নামে জোরপূর্বক বিদেশ পাঠানো হয় এবং সেখানে অবস্থানকালে গোয়েন্দা সংস্থার মাধ্যমে পদত্যাগপত্র আদায় করা হয়।
